Section 5 Customer SupportPart Number 000007646 11/10 17Commercial Ice Machine WarrantyLIMITED WARRANTY FOR ICE STORAGE BIN & DISPENSERSLIMITED WARRANTYManitowoc Ice a division of Manitowoc FSG Services, LLC,(“Company”) warrants that new Ice Storage Bins or Dispensers sold byCompany shall be free of defects in material or workmanship undernormal and proper use and maintenance as specified by the Companyand upon proper installation and start-up in accordance with theinstruction manual supplied.WHAT IS COVEREDParts and Labor for a period of three (3) years.Accessory Ice Transport Carts for two (2) years parts and labor.The Ice Storage Bin / Dispenser warranty begins on the date of theoriginal installation. This warranty shall not apply to any Ice StorageBin or Dispenser initially installed more than five (5) years from theserial number production date.The obligation of the Company under this warranty is limited to therepair or replacement of parts, components, or assemblies that in thesole opinion of the Company are defective. This warranty is furtherlimited to the cost of parts, components or assemblies and standardstraight time labor charges at the servicing location.Time and hourly rate schedules, as published from time to time by theCompany, apply to all service procedures. Additional expensesincluding without limitation, travel time, overtime premium, materialcost, accessing or removal of the Ice Storage Bin / Dispenser, orshipping are the responsibility of the purchaser, along with allmaintenance, adjustments, cleaning, and ice purchases. Laborcovered under this warranty must be performed by an approvedCompany contracted Service Representative or a refrigeration serviceagency as qualified and authorized by the Company's local Distributor.The Company's liability under this warranty shall in no event be greaterthan the actual purchase price paid by purchaser for the Ice StorageBin or Dispenser.EXCLUSIONS FROM COVERAGE• Repair or replacement of parts required because of misuse,improper care or storage, negligence, alteration, use ofincompatible supplies or lack of specified maintenance shall beexcluded.• Normal maintenance items.• Failures caused by adverse environmental, water conditions, orimproper drainage.• Improper or unauthorized repair.• Any Ice Storage Bin / Dispenser that has been installed and/ormaintained inconsistent with the instructions provided by theCompany.• Parts subject to damage beyond the control of Company, or to IceStorage Bin’s / Dispenser’s which have been subject to accidents,damage in shipment, fire, floods, other hazards or acts of God thatare beyond the control of the Company.• This Limited Warranty shall not apply if the Ice Storage Bin /Dispenser is modified with parts and assemblies other than thosemanufactured by the Company, unless the Company approvesthese modifications for specific locations in writing prior to thecommencement of such modification.LIMITATIONS OF LIABILITYThe preceding paragraphs set forth the exclusive remedy for all claimsbased on failure of, or defect in, Ice Storage Bins or Dispensers soldhereunder, whether the failure or defect arises before or during thewarranty period, and whether a claim, however instituted, is based oncontract, indemnity, warranty, tort (including negligence), strict liability,implied by statute, common-law or otherwise, and Company andagents shall not be liable for any claims for personal injuries orconsequential damages or loss, howsoever caused. Upon theexpiration of the warranty period, all such liability shall terminate. THEFOREGOING WARRANTIES ARE EXCLUSIVE AND IN LIEU OF ALLOTHER WARRANTIES, WHETHER WRITTEN, ORAL, IMPLIED ORSTATUTORY NO IMPLIED WARRANTY OF MERCHANTABILITY ORFITNESS FOR PARTICULAR PURPOSE SHALL APPLY, COMPANYDOES NOT WARRANT ANY PRODUCTS OR SERVICES OFOTHERSREMEDIESThe liability of Company for breach of any warranty obligationhereunder is limited to: (i) the repair or replacement of the Ice StorageBin or Dispenser on which the liability is based, or with respect toservices, re-performance of the services; or (ii) at Company’s option,the refund of the amount paid for said equipment or services. Anybreach by Company with respect to any item or unit of equipment orservices shall be deemed a breach with respect to that item or unit orservice only.WARRANTY CLAIM PROCEDURECustomer shall be responsible to:• Complete and return warranty registration card or register on linewithin five (5) days from the installation date.• All warranty service must be preformed by an approvedManitowoc contracted or authorized Service Representative. Toschedule a service appointment contact your local ManitowocService Representative or visit us at www.manitowocice.com tofind a Service Representative near you.GOVERNING LAWThis Limited Warranty shall be governed by the laws of the state ofWisconsin, USA, excluding their conflicts of law principles.
