62 • Software UtilityProduct Warranty/ServiceSeller warrants that equipment furnished will be free from defects inmaterial and workmanship for a period of one year from theconfirmed date of purchase of the original buyer and that uponwritten notice of any such defect, Seller will, at its option, repair orreplace the defective item under the terms of this warranty, subjectto the provisions and specific exclusions listed herein.This warranty shall not apply to equipment that has been previouslyrepaired or altered outside our plant in any way as to, in thejudgment of the manufacturer, affect its reliability. Nor will it apply ifthe equipment has been used in a manner exceeding itsspecifications or if the serial number has been removed.Seller does not assume any liability for consequential damages as aresult from our product uses, and in any event our liability shall notexceed the original selling price of the equipment.The equipment warranty shall constitute the sole and exclusiveremedy of any Buyer of Seller equipment and the sole and exclusiveliability of the Seller, its successors or assigns, in connection withequipment purchased and in lieu of all other warranties expressedimplied or statutory, including, but not limited to, any impliedwarranty of merchant ability or fitness and all other obligations orliabilities of seller, its successors or assigns.The equipment must be returned postage-prepaid. Package itsecurely and insure it. You will be charged for parts and labor if youlack proof of date of purchase, or if the warranty period is expired.
