10. Automatic Licensing of Downstream Recipients. Each time you convey a covered work, the recipientautomatically receives a license from the original licensors, torun, modify and propagate that work, subject to this License. You are not responsible for enforcing compliance by thirdparties with this License. An “entity transaction” is a transaction transferring controlof an organization, or substantially all assets of one, orsubdividing an organization, or merging organizations. If propagation of a covered work results from an entitytransaction, each party to that transaction who receives acopy of the work also receives whatever licenses to the workthe party’s predecessor in interest had or could give underthe previous paragraph, plus a right to possession of theCorresponding Source of the work from the predecessorin interest, if the predecessor has it or can get it withreasonable efforts. You may not impose any further restrictions on the exerciseof the rights granted or affirmed under this License. Forexample, you may not impose a license fee, royalty, or othercharge for exercise of rights granted under this License, and you may not initiate litigation (including a cross-claimor counterclaim in a lawsuit) alleging that any patent claimis infringed by making, using, selling, offering for sale, orimporting the Program or any portion of it.11. Patents.A “contributor” is a copyright holder who authorizes useunder this License of the Program or a work on which theProgram is based. The work thus licensed is called thecontributor’s “contributor version”.A contributor’s “essential patent claims” are all patent claimsowned or controlled by the contributor, whether alreadyacquired or hereafter acquired, that would be infringed bysome manner, permitted by this License, of making, using,or selling its contributor version, but do not include claimsthat would be infringed only as a consequence of furthermodification of the contributor version. For purposes ofthis definition, “control” includes the right to grant patentsublicenses in a manner consistent with the requirementsof this License. Each contributor grants you a non-exclusive, worldwide,royalty-free patent license under the contributor’s essentialpatent claims, to make, use, sell, offer for sale, import andotherwise run, modify and propagate the contents of itscontributor version. In the following three paragraphs, a “patent license” is anyexpress agreement or commitment, however denominated, not to enforce a patent (such as an express permissionto practice a patent or covenant not to sue for patentinfringement). To “grant” such a patent license to a partymeans to make such an agreement or commitment not toenforce a patent against the party. If you convey a covered work, knowingly relying on a patentlicense, and the Corresponding Source of the work is notavailable for anyone to copy, free of charge and under theterms of this License, through a publicly available networkserver or other readily accessible means, then you musteither (1) cause the Corresponding Source to be so available,or (2) arrange to deprive yourself of the benefit of the patentlicense for this particular work, or (3) arrange, in a mannerconsistent with the requirements of this License, to extendthe patent license to downstream recipients. “Knowinglyrelying” means you have actual knowledge that, but for thepatent license, your conveying the covered work in a country,or your recipient’s use of the covered work in a country, would infringe one or more identifiable patents in that countrythat you have reason to believe are valid. If, pursuant to or in connection with a single transactionor arrangement, you convey, or propagate by procuringconveyance of, a covered work, and grant a patent licenseto some of the parties receiving the covered work authorizingthem to use, propagate, modify or convey a specific copyof the covered work, then the patent license you grant isautomatically extended to all recipients of the covered workand works based on it.A patent license is “discriminatory” if it does not includewithin the scope of its coverage, prohibits the exerciseof, or is conditioned on the nonexercise of one or more ofthe rights that are specifically granted under this License. You may not convey a covered work if you are a party toan arrangement with a third party that is in the business ofdistributing software, under which you make payment to thethird party based on the extent of your activity of conveyingthe work, and under which the third party grants, to any ofthe parties who would receive the covered work from you,a discriminatory patent license (a) in connection with copiesof the covered work conveyed by you (or copies made fromthose copies), or (b) primarily for and in connection withspecific products or compilations that contain the coveredwork, unless you entered into that arrangement, or thatpatent license was granted, prior to 28 March 2007.Nothing in this License shall be construed as excluding orlimiting any implied license or other defenses to infringementthat may otherwise be available to you under applicablepatent law.12. No Surrender of Others’ Freedom. If conditions are imposed on you (whether by court order, agreement or otherwise) that contradict the conditions ofthis License, they do not excuse you from the conditions ofthis License. If you cannot convey a covered work so as tosatisfy simultaneously your obligations under this Licenseand any other pertinent obligations, then as a consequenceyou may not convey it at all. For example, if you agreeto terms that obligate you to collect a royalty for furtherconveying from those to whom you convey the Program, theonly way you could satisfy both those terms and this Licensewould be to refrain entirely from conveying the Program.13. Use with the GNU Affero General Public License.Notwithstanding any other provision of this License, youhave permission to link or combine any covered work witha work licensed under version 3 of the GNU Affero GeneralPublic License into a single combined work, and to conveythe resulting work. The terms of this License will continue toapply to the part which is the covered work, but the specialrequirements of the GNU Affero General Public License, section 13, concerning interaction through a network willapply to the combination as such.14. Revised Versions of this License. The Free Software Foundation may publish revised and/or new versions of the GNU General Public License fromtime to time. Such new versions will be similar in spirit tothe present version, but may differ in detail to address newproblems or concerns. Each version is given a distinguishing version number. If theProgram specifies that a certain numbered version of theGNU General Public License “or any later version” applies toit, you have the option of following the terms and conditionseither of that numbered version or of any later versionpublished by the Free Software Foundation. If the Programdoes not specify a version number of the GNU GeneralPublic License, you may choose any version ever publishedby the Free Software Foundation. If the Program specifies that a proxy can decide which futureversions of the GNU General Public License can be used, that proxy’s public statement of acceptance of a versionpermanently authorizes you to choose that version for theProgram.Later license versions may give you additional or differentpermissions. |
