23STATEMENT OF LIMITED PRODUCTWARRANTYGaggenau Wine Preservation UnitWhat this Warranty Covers & Who it Applies to: The limitedwarranty provided BSH Home Appliances in this Statement ofLimited Product Warranty applies only to the Gaggenauappliance (“Product”) sold to you, the first using purchaser,provided that the Product was purchased: (1) for your normal,household (non-commercial) use, and has in fact at all times onlybeen used for normal household purposes; (2) new at retail (nota display, “as is”, or previously returned model), and not forresale, or commercial use; and (3) within the United States orCanada, and has at all times remained within the country oforiginal purchase. The warranties stated herein apply only to thefirst purchaser of the Product and are not transferable.Gaggenau reserves the right to request proof of purchase at thetime any warranty claim is submitted to confirm that the Productfalls within the scope of this limited product warranty. Please make sure to return your registration card; while notnecessary to effectuate warranty coverage, it is the best wayfor Gaggenau to notify you in the unlikely event of a safetynotice or product recall.How Long the Warranty Lasts: Gaggenau warrants that theProduct is free from defects in materials and workmanship fora period of one thousand eight hundred twenty five (1,825) days(5 years) from the date of purchase. The foregoing timelinebegins to run upon the date of purchase, and shall not be stalled,tolled, extended, or suspended, for any reason whatsoever.Repair/Replace as Your Exclusive Remedy: During thiswarranty period, Gaggenau or one of its authorized serviceproviders will repair your Product without charge to you (subjectto certain limitations stated herein) if your Product proves to havebeen manufactured with a defect in materials or workmanship.If a reasonable number of attempts to repair the Product havebeen made without success, then Gaggenau will replace yourProduct (upgraded models may be available to you, inGaggenau’s sole discretion, for an additional charge).All removed parts and components shall become the property ofGaggenau at its sole option. All replaced and/or repaired partsshall assume the identity of the original part for purposes of thiswarranty and this warranty shall not be extended with respect tosuch parts.Gaggenau’s sole liability and responsibility hereunder is to repairmanufacturer-defective Product only, using a Gaggenau-authorized service provider during normal business hours.For safety and property damage concerns, Gaggenau highlyrecommends that you do not attempt to repair the Productyourself, or use an un-authorized servicer; Gaggenau will have noresponsibility or liability for repairs or work performed by a non-authorized servicer. If you choose to have someone other thanan authorized service provider work on your Product, THISWARRANTY WILL AUTOMATICALLY BECOME NULL ANDVOID. Authorized service providers are those persons orcompanies that have been specially trained on Gaggenauproducts, and who possess, in Gaggenau’s opinion, a superiorreputation for customer service and technical ability (note thatthey are independent entities and are not agents, partners,affiliates or representatives of Gaggenau).Notwithstanding the foregoing, Gaggenau will not incur anyliability, or have responsibility, for the Product if it is located ina remote area (more than 100 miles from an authorized serviceprovider) or is reasonably inaccessible, hazardous, threatening,or treacherous locale, surroundings, or environment; in any suchevent, if you request, Gaggenau would still pay for labor and partsand ship the parts to the nearest authorized service provider, butyou would still be fully liable and responsible for any travel time orother special charges by the service company, assuming theyagree to make the service call.Extended Limited Warranty: Sixth thru twelfth year from date ofpurchase warranty on sealed refrigeration system parts only aslisted. Gaggenau will pay for factory specified replacement partsonly to correct defects in materials or workmanship in the sealedrefrigeration system. These parts are compressor, evaporator,condenser, dryer, and connecting tubing. Service must beperformed by a Gaggenau designated service company.Out of Warranty Product: Gaggenau is under no obligation, atlaw or otherwise, to provide you with any concessions, includingrepairs, prorates, or Product replacement, once this warranty hasexpired.Warranty Exclusions: The warranty coverage described hereinexcludes all defects or damage that are not the direct fault ofGaggenau, including without limitation, one or more of thefollowing: (1) use of the Product in anything other than its normal,customary and intended manner (including without limitation, anyform of commercial use, use or storage of an indoor productoutdoors, use of the Product in conjunction with air or water-going vessels); (2) any party's willful misconduct, negligence,misuse, abuse, accidents, neglect, improper operation, failure tomaintain, improper or negligent installation, tampering, failure tofollow operating instructions, mishandling, unauthorized service(including self-performed “fixing” or exploration of the appliance'sinternal workings); (3) adjustment, alteration or modification of anykind; (4) a failure to comply with any applicable state, local, city,or county electrical, plumbing and/or building codes, regulations,or laws, including failure to install the product in strict conformitywith local fire and building codes and regulations; (5) ordinarywear and tear, spills of food, liquid, grease accumulations, orother substances that accumulate on, in, or around the Product;and (6) any external, elemental and/or environmental forces andfactors, including without limitation, rain, wind, sand, floods, fires,mud slides, freezing temperatures, excessive moisture orextended exposure to humidity, lightning, power surges,structural failures surrounding the appliance, and acts of God.In no event shall Gaggenau have any liability or responsibilitywhatsoever for damage to surrounding property, includingcabinetry, floors, ceilings, and other structures or objects aroundthe Product. Also excluded from this warranty are scratches,nicks, minor dents, and cosmetic damages on external surfacesand exposed parts; Products on which the serial numbers havebeen altered, defaced, or removed; service visits to teach youhow to use the Product, or visits where there is nothing wrongwith the Product; correction of installation problems (you aresolely responsible for any structure and setting for the Product,including all electrical, plumbing or other connecting facilities,for proper foundation/flooring, and for any alterations includingwithout limitation cabinetry, walls, floors, shelving, etc.); andresetting of breakers or fuses.
