EMISSIONS CONTROL SYSTEM WARRANTY34Sears, Roebuck and Co., U.S.A. (Sears), the California Air Resources Board (CARB) andthe United States Environmental Protection Agency (U.S.EPA)Emissions Control System Warranty Statement(Owner's Defect Warranty Rights and Obligations)In the USA and Canada, a 24-hour hotline, 1-800-469-4663, has a menu of pre-recorded messages offering you productmaintenance information.The California Air Resources Board (CARB), U.S. EPA andSears are pleased to explain the Emissions Control SystemWarranty on your small offroad engine (SORE). InCalifornia, new small offroad engines model year 2006 andlater must be designed, built and equipped to meet theState’s stringent anti-smog standards.Elsewhere in the United States, new non-road, spark-ignitionengines certified for model year 1997 and later must meetsimilar standards set forth by the U.S. EPA. Sears mustwarrant the emissions control system on your engine for theperiods of time listed below, provided there has been no abuse,neglect or improper maintenance of your small off-road engine.Your emissions control system includes parts such as thecarburetor, air cleaner, ignition system, fuel line, muffler andcatalytic converter. Also included may be connectors andother emissions related assemblies.Where a warrantable condition exists, Sears will repair yoursmall off-road engine at no cost to you including diagnosis,parts and labor.Sears, Roebuck and Co. Emissions Control DefectsWarranty CoverageSmall off-road engines are warranted relative to emissionscontrol parts defects for a period of two years, subject toprovisions set forth below. If any covered part on your engineis defective, the part will be repaired or replaced by Sears.Owner’s Warranty ResponsibilitiesAs the small off-road engine owner, you are responsible forthe performance of the required maintenance listed in yourOperating and Maintenance Instructions. Sears recommendsthat you retain all your receipts covering maintenance onyour small off-road engine, but Sears cannot deny warrantysolely for the lack of receipts or for your failure to ensure theperformance of all scheduled maintenance.As the small off-road engine owner, you should however beaware that Sears may deny you warranty coverage if yoursmall off-road engine or a part has failed due to abuse,neglect, improper maintenance or unapproved modifications.You are responsible for presenting your small off-roadengine to an Authorized Sears Service Dealer as soon as aproblem exists.The undisputed warranty repairs should be completed in areasonable amount of time, not to exceed 30 days.If you have any questions regarding your warranty rightsand responsibilities, you should contact a Sears ServiceRepresentative at 1-800-469-4663.The emissions warranty is a defects warranty. Defects arejudged on normal engine performance. The warranty is notrelated to an in-use emissions test.Sears, Roebuck and Co. Emissions Control DefectsWarranty ProvisionsThe following are specific provisions relative to yourEmissions Control Defects Warranty Coverage. It is inaddition to the Sears engine warranty for non-regulatedengines found in the Operating and Maintenance Instructions.1. Warranted PartsCoverage under this warranty extends only to the partslisted below (the emissions control systems parts) to theextent these parts were present on the engine purchased.a. Fuel Metering System• Cold start enrichment system• Carburetor and internal parts• Fuel Pump• Fuel line, fuel line fittings, clampsb. Air Induction System• Air cleaner• Intake manifoldc. Ignition System• Spark plug(s)• Magneto ignition systemd. Catalyst System• Catalytic converter• Exhaust manifold• Air injection system, Pulse valvee. Miscellaneous Items• Vacuum, temperature, position, time sensitive valvesand switches• Connectors and assemblies2. Length of CoverageSears warrants to the initial owner and each subsequentpurchaser that the Warranted Parts shall be free fromdefects in materials and workmanship which caused thefailure of the Warranted Parts for a period of two yearsfrom the date the engine is delivered to a retail purchaser.3. No ChargeRepair or replacement of any Warranted Part will beperformed at no charge to the owner, includingdiagnostic labor which leads to the determination that aWarranted Part is defective, if the diagnostic work isperformed at an Authorized Sears Service Dealer.4. Claims and Coverage ExclusionsWarranty claims shall be filed in accordance with theprovisions of the Sears Engine Warranty Policy.Warranty coverage shall be excluded for failures ofWarranted Parts which are not original Sears parts orbecause of abuse, neglect or improper maintenance asset forth in the Sears Engine Warranty Policy. Sears isnot liable to cover failures of Warranted Parts caused bythe use of add-on, non-original, or modified parts.5. MaintenanceAny Warranted Part which is not scheduled forreplacement as required maintenance or which isscheduled only for regular inspection to the effect of“repair or replace as necessary” shall be warranted as todefects for the warranty period. Any Warranted Part whichis scheduled for replacement as required maintenanceshall be warranted as to defects only for the period of timeup to the first scheduled replacement for that part. Anyreplacement part that is equivalent in performance anddurability may be used in the performance of anymaintenance or repairs. The owner is responsible for theperformance of all required maintenance, as defined in theSears Operating and Maintenance Instructions.6. Consequential CoverageCoverage hereunder shall extend to the failure of anyengine components caused by the failure of anyWarranted Part still under warranty. |
